This morning at the Subcommittee on Oversight and Investigations hearing entitled “Protecting Medicare with Improvements to the Secondary Payer Regime,” Committee Chairman Cliff Stearns opened with a statement that seriously admonished CMS for its administration of its MSP programs, and truly its lack thereof for the first 20 of the 30 years since the MSP was passed into law. He stated that whenever defendants, insurance companies, and attorneys alike are all anxious to pay the federal government and can’t get an answer, then there’s something seriously wrong with the system. Now that they see our dilemma, maybe Congress can finally make some progress fixing the problem.
