CMS Alert Changes Reporting Threshold

Due to an overwhelming number of inquiries today, we want to clarify that the February 18, 2014 Alert does expressly state that “physical trauma-based liability settlements of $1000 or less do not need to be reported….” The Alert also specifically states that “[the content of this Alert supersedes the content of the existing Medicare Secondary Payer Mandatory Reporting Non-Group Health Plan User Guide (Version 4.1), and will be incorporated into the next version of the User Guide”, meaning that the $2,000 threshold that became effective January 1, 2014 and was supposed to stay in effect until the $300 threshold is implemented on January 1, 2015 has been replaced [see MMSEA User Guide Table 6-6]. Because it is unclear if CMS meant to supersede the previously established threshold, it would be prudent to monitor CMS’ website for clarification of this policy change, but know that MEDVAL will post an update should any changes transpire.
