CMS Issues Revised and Modified Pre-Solicitation Notice

We have been reporting over the last several months that CMS was soliciting bids for an RFP for the Workers’ Compensation Review Contractor (WCRC), to review WCMSA proposals.  We have been anxiously awaiting CMS’ revised and modified pre-solicitation notice, which was previously scheduled to be out in June.  Well, today, it’s finally out.  The pre-solicitation notice released today, indicates that CMS anticipates releasing a solicitation for the WCRC contractor on or about September 22, 2016, with a proposal due date of October 24, 2016. The notice also indicates a revised anticipated award date of February 8, 2016.

We are curious as to whether this notice also means guidelines for review of liability MSAs will shortly be released, as well, as chatter regarding pending release of these guidelines continues.  More importantly, the scope of this modified pre-solicitation notice has also been amended to reflect the review “..on an optional basis…[of] proposals from other non-group-health plans…”  This certainly might include MSAs for liability settlements.  It also remains to be seen as to whether the thresholds will be modified, as we previously reported, as well.

We will continue to keep you updated regarding new developments, but it appears we will certainly see some significant changes in the coming months.
