Update: CMS Review Contractor Solicitation and Award Date Delayed

As you know, we have been anticipating the release of CMS’ final solicitation for bids for an RFP for the Workers’ Compensation Review Contractor (WCRC) to review WCMSA proposals.  The pre-solicitation bid was to be released on September 22, 2016.  However, September 22, came and went without the release of the solicitation.  We finally received confirmation that once again there is an additional delay, and that release has been postponed.  CMS now anticipates releasing the bid during the first quarter of fiscal year 2017.  The contract for a new WCRC will still be awarded on a firm fixed price (FFP) basis and will include a 12 month base period plus four (4) one (1) year options.  The revised anticipated award date is second quarter of FY 2017 and is expected to be issued pending availability of funds.  As we have seen firsthand, these dates are subject to change.

It still remains to be seen, whether guidelines for review of liability MSAs or modifications to current review thresholds will be released prior to release of the solicitation.  We certainly expect to see some forthcoming changes, but now unlikely until the second quarter of fiscal year 2017.

We will continue to keep you updated regarding any new developments, but for now, it appears to be business as usual.
