As we previously reported, CMS awarded the Workers’ Compensation Review Contractor (WCRC) contract to Capitol Bridge, LLC, which was subsequently protested by two other companies who participated in the bidding process.  The protests were recently denied, but the decisions are covered by protective orders and must be redacted before being published.  Once available, the decisions can be found here.

The ultimate outcome of these denied protests remains to be seen, as a bid protest may be subject to a request for reconsideration, and that is certainly a possibility here.  Furthermore, it is not clear as to when Capitol Bridge will begin its role as the new WCRC, and how this will affect the review of Medicare Set-Asides submitted through CMS’ voluntary review process.  We will be sure to update you on any news as related to the transition.
